These Terms of Use govern the relationship between TDJ Basketball Academy ("the Academy") and its clients. By purchasing or using any services offered by the Academy, you agree to these Terms and Conditions.

1. Definitions

  • "Credits": Refers to pre-purchased sessions that can be used for booking basketball training.

  • "Membership": Refers to a recurring subscription or one-time payment plan entitling clients to specific services and benefits.

  • "Account Freeze": A temporary suspension of membership or credit expiration under specific conditions.

  • "No-show": Defined as a client failing to attend a scheduled session without prior cancellation.

2. Scope of Services

TDJ Basketball Academy offers various services, including basketball training sessions, memberships, training credits, events, and programs. The specific services available may vary, and clients are encouraged to check the Academy’s official website or contact us for the most up-to-date offerings.

3. Purchase, Transfer, and Use of Credits and Memberships

3.1 Credits

  • Credits purchased are valid for three (3) months from the date of purchase and can be used to book available basketball training sessions.

  • Additional credit purchases reset the expiration date to three (3) months from the latest purchase.

  • Credits may be transferred to other clients for a $50 registration fee, subject to prior written approval by the Academy.

3.2 Memberships

  • Memberships are billed according to the plan selected at sign-up (monthly, quarterly, or annual) and are non-transferable unless otherwise specified.

  • Membership benefits, including access to exclusive sessions or events, are limited to the duration of the membership term and are subject to availability.

4. Account Freezes

Clients may request an account freeze for up to three (3) months in any twelve (12) month period if they cannot use their credits or memberships due to unforeseen circumstances. Valid documentation, such as medical certificates or travel confirmations, is required for approval. During the freeze period, the expiration of credits and membership benefits will be paused.

5. Refund Policy

5.1 Credits

  • All credit purchases are final and non-refundable.

  • In exceptional cases, unused credits may be converted into gift cards or account funds at the discretion of the Academy.

5.2 Memberships

  • Memberships are non-refundable. Clients may cancel memberships before the next billing cycle to avoid additional charges but will not receive refunds for partial use within a billing period.

5.3 Events and Special Programs

  • Cancellations for events or programs must be made at least 48 hours in advance for a partial refund (minus a processing fee), subject to Academy approval.

6. Liability and Assumption of Risks

6.1 Acknowledgment of Risks

Clients acknowledge that participation in basketball training, events, and related activities provided by the Academy involves inherent risks. These risks include, but are not limited to:

  • Physical injuries such as sprains, fractures, or concussions.

  • Health complications arising from strenuous physical activity.

  • Risks associated with the use of training facilities, equipment, and playing surfaces.

6.2 Medical Responsibility

Clients are responsible for ensuring they are physically fit and medically cleared to participate in training sessions or events. It is strongly recommended that clients consult a qualified medical professional before engaging in any physical activity.

6.3 Release of Liability

To the fullest extent permitted by Singapore law, the Academy, its directors, officers, employees, contractors, agents, and volunteers are not liable for any injury, loss, damage, or harm arising from participation in the Academy’s services, except where such injury or harm is caused by gross negligence or willful misconduct on the part of the Academy.

6.4 Indemnity Clause

Clients agree to indemnify and hold harmless the Academy and its representatives against all claims, damages, costs, and legal fees arising from:

  • Any breach of these Terms and Conditions.

  • Their own negligence or misconduct during participation in training sessions, events, or while using Academy facilities.

6.5 Emergency Consent

In the event of a medical emergency, clients authorize the Academy to seek appropriate medical assistance, including transportation to a medical facility, and agree to bear any associated costs.

7. Session Cancellations and No-Show Policy

  • Clients must cancel scheduled sessions at least 24 hours in advance to avoid losing credits or forfeiting membership sessions.

  • No-shows and cancellations within 24 hours of the scheduled session time result in credit or session deduction without rescheduling.

8. Modifications to Terms

The Academy reserves the right to amend these Terms and Conditions at any time. Updated terms will be posted on the Academy’s website or communicated through email. Continued use of services after such changes constitutes acceptance of the updated terms.

9. Dispute Resolution and Mediation Clause

Any disputes arising out of these Terms and Conditions will be governed by Singapore law. Parties agree to attempt mediation before resorting to litigation, with the courts of Singapore having exclusive jurisdiction.

10. Force Majeure

The Academy is not responsible for failure to fulfill obligations due to events beyond its control, including natural disasters, government restrictions, and public health emergencies. Credits, memberships, or services may be adjusted or paused in such circumstances.

11. Intellectual Property Rights

All training materials, proprietary methods, and branded items provided or displayed during sessions, events, or on the website remain the property of the Academy. Clients are prohibited from reproducing, distributing, or publicly displaying these materials without written consent.

12. Privacy and Data Protection

The Academy is committed to protecting personal data in compliance with Singapore’s PDPA. By using our services, clients consent to the collection, use, and disclosure of their data as outlined in our Privacy Policy, which is available on our website.

13. Acknowledgment

13.1 Consent to Terms

By purchasing or using any of the Academy’s services, including credits, memberships, or event participation, clients confirm their understanding and acceptance of these Terms and Conditions, including the Liability and Assumption of Risks section. This acknowledgment is binding and serves as a waiver of claims to the extent permitted by Singapore law.

13.2 Electronic Agreement

By completing the booking or purchase process through the Academy’s website, email, WhatsApp, or other approved channels, clients acknowledge that this electronic agreement is as legally binding as a signed document.

13.3 Availability of Terms

The Academy’s Terms and Conditions are available on its website, and clients are encouraged to review them regularly. Updates to these Terms will be communicated via email or the Academy’s official website.
